Please read these terms and conditions carefully before using the Bwatoo platform.

These Terms and Conditions (hereinafter "Terms") govern the use of the Bwatoo platform, accessible via the website bwatoo.com and associated mobile applications. By using our services, you agree to be bound by these Terms. If you do not accept these conditions, you must not use our platform.
Article 1 - Purpose and Scope
These Terms are intended to define the conditions of use of the Bwatoo platform, which includes:
- -A service connecting buyers and sellers of goods and services
- -A service for publishing and viewing classified ads
- -A messaging service between users
- -A package delivery service between users
These Terms apply to all users of the platform, whether individuals or businesses, sellers or buyers, located in Africa or elsewhere in the world.
Article 2 - Definitions
In these Terms, the following words have the following meanings:
Platform : Refers to all services offered by Bwatoo, accessible via the website bwatoo.com and iOS and Android mobile applications.
User : Any natural or legal person who accesses the Platform and uses its services, whether or not they have an account.
Seller : Any User who publishes an ad to sell a good or offer a service on the Platform.
Buyer : Any User who views ads and contacts a Seller to acquire a good or service.
Ad : Any offer to sell goods or services published by a User on the Platform.
Service : All features made available to Users by Bwatoo, including ad publishing, messaging, and delivery.
User Account : Personal space created by a User upon registration, allowing them to access all features of the Platform.
Delivery Driver : Any User registered as a delivery partner and making deliveries on behalf of other Users.
Article 3 - Registration and User Account
3.1 Registration Requirements
- -Be at least 18 years old or have authorization from a legal guardian
- -Provide accurate, complete, and up-to-date information during registration
- -Create only one account per natural or legal person
- -Have the legal capacity to contract
3.2 User Obligations
- -Maintain the confidentiality of login credentials
- -Update personal information in case of changes
- -Not transfer or assign the account to a third party
- -Immediately report any unauthorized use of the account
Users may request deletion of their account at any time via profile settings or by contacting customer service. Deletion results in the erasure of personal data in accordance with our privacy policy.
Article 4 - Ad Publishing
4.1 Publishing Rules
- -The description must be honest, accurate, and correspond to the item offered
- -Photos must be real photos of the item (no generic internet images)
- -The price must be realistic and clearly indicated in the appropriate currency
- -The ad must be published in the appropriate category
- -Only one ad per item (no duplicates)
4.2 Prohibited Content
- - Illegal items or items whose sale is prohibited under Gabonese law
- - Firearms, bladed weapons, explosives, and ammunition
- - Drugs, narcotics, and prescription-free medications
- - Counterfeit items, copies, or brand replicas
- - Pornographic or adult content
- - Stolen items or items of dubious origin
- - Protected animals or endangered species
- - Discriminatory, hateful, or violence-inciting content
- - Illegal services or services contrary to public morals
Bwatoo reserves the right to refuse, modify, or remove any ad that does not comply with these rules, without notice or compensation.
Article 5 - Transactions Between Users
Bwatoo acts as a technical intermediary connecting Sellers and Buyers. Transactions are concluded directly between Users.
5.1 Transaction Principles
- -Users contact each other via the integrated messaging system or provided contact details
- -Sale conditions (price, terms, delivery) are negotiated directly between parties
- -It is recommended to verify the item before any payment
- -Payment is made directly between Seller and Buyer, or via the Bwatoo secure payment system
Warning: Bwatoo strongly recommends meeting the seller in a public place, verifying the item before payment, and never sending money in advance without seeing the item.
The Bwatoo secure payment system protects transactions by holding funds until the Buyer confirms receipt of the item.
Article 6 - Delivery Service
Bwatoo offers a delivery service allowing Users to have their purchases delivered by partner Delivery Drivers.
6.1 Delivery Service Conditions
- -The service is available in geographic areas covered by our network of Delivery Drivers
- -Packages must comply with specified weight and dimension limits
- -The Seller is responsible for proper packaging of the item
- -The recipient must be present at the indicated address to receive the package
6.2 Items Prohibited from Transport
- -Dangerous, flammable, or explosive materials
- -Perishable goods without suitable packaging
- -Items of exceptional value without additional insurance
- -Any item prohibited by these Terms
Basic insurance is included in the delivery service. For valuable items, additional insurance can be taken out when requesting delivery.
Article 7 - Bwatoo's Responsibilities
Bwatoo is committed to providing quality service to its Users.
7.1 Bwatoo's Commitments
- -Ensure Platform availability under reasonable conditions
- -Implement security measures to protect User data
- -Moderate reported content as quickly as possible
- -Provide accessible and responsive customer support
7.2 Limitation of Liability
- -Bwatoo is not responsible for the content of ads published by Users
- -Bwatoo is not a party to transactions between Users and does not guarantee their proper execution
- -Bwatoo is not responsible for indirect damages related to use of the Platform
- -Bwatoo does not guarantee uninterrupted service and may perform maintenance
Article 8 - User Responsibilities
Users are solely responsible for their use of the Platform.
- -The content they publish (text, photos, information)
- -The accuracy of information provided in their ads
- -The legality of items and services offered for sale
- -Compliance with their tax and legal obligations
- -Resolution of disputes with other Users
The User agrees to indemnify Bwatoo for any damage, costs, or judgments resulting from a violation of these Terms or applicable laws.
Article 9 - Intellectual Property
9.1 Bwatoo's Property
The Platform, its architecture, design, logos, trademarks, and original content are the exclusive property of Bwatoo SARL. Any unauthorized reproduction, representation, modification, or exploitation is strictly prohibited.
9.2 User Content
Users retain ownership of their content (text, photos, descriptions). They warrant that they have all necessary rights to published content and do not infringe third-party rights.
9.3 License Granted to Bwatoo
By publishing content on the Platform, the User grants Bwatoo a worldwide, non-exclusive, royalty-free license to use, reproduce, and display this content for the operation of the Service.
Article 10 - Personal Data Protection
Protecting your personal data is a priority for Bwatoo. We are committed to complying with Gabonese data protection legislation.

Article 11 - Moderation and Sanctions
Bwatoo reserves the right to moderate content and behavior on the Platform to ensure compliance with these Terms.
11.1 Applicable Measures
- -Email warning
- -Removal of the ad in question
- -Temporary account suspension
- -Permanent account suspension for repeated or serious violations
- -Legal action in case of criminal offense
Users may contest a moderation decision by contacting customer service within 15 days. Bwatoo commits to carefully examining each appeal.
Article 12 - Modification of Terms
Bwatoo reserves the right to modify these Terms at any time.
- -Changes will be notified to Users by email and/or on the Platform
- -A 15-day period will be granted before changes take effect
- -Continued use of the Platform after this period constitutes acceptance of the new Terms
If the new conditions are refused, the User may request account deletion before the changes take effect.
Article 13 - Applicable Law and Jurisdiction
These Terms are governed by Gabonese law. Any dispute relating to the interpretation or execution of these Terms shall be subject to Gabonese law.
In case of dispute, the parties agree to seek an amicable solution before any legal action. A mediation procedure may be initiated at the request of either party.
Failing amicable agreement within 30 days, the courts of Libreville (Gabon) shall have sole jurisdiction to hear the dispute.
